Draft pending legal review. Details shown in square brackets will be completed before launch.

These terms govern the use of 4cleanibiza.com and the contracting of services through the platform. Please read them before booking or offering your services: by registering or booking, you accept them together with the Cancellation policy and the Privacy policy.

1. Who we are and what we do

4clean Ibiza is a service of [Razón social pendiente] (Tax ID (NIF) [NIF pendiente]), with its registered address at [Domicilio social pendiente], Ibiza, Illes Balears (hereinafter “4clean”).

4clean is a platform that connects people who need cleaning for their house, villa or boat in Ibiza (“clients”) with independent professionals who provide it (“professionals”). 4clean manages search, booking, payment, chat and reviews, but does not provide the cleaning services: the service contract is concluded between the client and each professional.

Professionals work on their own account, as self-employed individuals or companies. There is no employment relationship between 4clean and the professionals, nor between the members of a team.

2. Registration and account

  • You must be 18 or over and provide true and up-to-date information.
  • Your account is personal. Keep your login details safe and let us know if you suspect any misuse.
  • Registration and sign-in are handled by our provider Clerk. You can sign in with your email or, where available, with an account from another service (for example, Google).
  • The same account can use both the client area and the professional area.

3. How a booking works

  1. Search. You enter the service, area, day, time, duration and, if needed, how many people. We only show you professionals (or teams) who can cover the entire service, including their travel margin.
  2. Request. You complete the details (address or mooring, size, access), accept these terms and pay by card in Stripe's secure form: the total amount is authorised (held) on your card, but not charged yet. The booking is then “awaiting acceptance”.
  3. Acceptance. The contract with the professional is concluded when they accept the request. At that moment the amount is charged and the exact address is shared. In a team booking, the charge is made once everyone has replied, and only for the share of those who accept. If nobody accepts it within 48 hours or before the start time, the request expires at no cost and the authorised amount is released.
  4. Service. The professional marks the start and the end. If more time is needed, they can propose extra hours, which are only charged if you accept them in the app, to the card you used when booking.
  5. Review. Once the service is completed, you can leave a review.

4. Prices and payments

Each professional sets their hourly rate and a minimum number of hours. The price you see before booking is the final price you pay: rate × hours, including applicable taxes and with no platform surcharges.

  • Payment processor. Payments are processed by Stripe (Stripe Payments Europe, Ltd., authorised by the Central Bank of Ireland). You pay in a Stripe form embedded in the website: your card details go directly to Stripe and 4clean never sees or stores your full card number. Your bank may ask you to confirm the payment (strong customer authentication, 3-D Secure), and Stripe applies anti-fraud checks (Stripe Radar) that may block a suspicious payment.
  • Authorisation and charge. When you send the request, the total amount is authorised on your card without being charged. It is charged when the professional accepts (in a team, once everyone has replied, and only the accepted share). If nobody accepts, the authorisation is released; how long it takes to disappear from your statement depends on your bank.
  • Saved card. When you pay, you agree that Stripe saves your card so that the extra hours you accept in the app during the service can be charged without you having to enter it again. We do not use it for any other charge. You can ask us to delete it by writing to hola@4cleanibiza.com.
  • Refunds. They are made in accordance with the Cancellation policy, through Stripe and to the same card, within 14 calendar days at most.
  • Commission and payments to professionals. 4clean collects the amount on behalf of the professional and transfers their share to them through Stripe Connect, less the 10% commission that 4clean charges the professional on the amount of each service. The share for a service is transferred once it is completed; for extra hours, when you accept them; and, if there is a late cancellation or no-show charge, the professional's share of that charge. The price you pay does not change.

5. Cancellations

The Cancellation policy applies and forms part of these terms. In short: cancelling a pending request is free, and so is cancelling a confirmed booking up to 24 hours before; with less notice, 50% is charged; if on arrival nobody is there or access is not possible, 100% is charged; if the professional cancels or fails to show up, 100% is refunded.

6. Disputes and chargebacks

If you disagree with a charge, please write to us first at hola@4cleanibiza.com or through the booking chat: that way we can review it and, where appropriate, refund it in accordance with the Cancellation policy. If you ask your bank to reverse a charge (chargeback), the dispute is handled through Stripe and the card networks, and we will provide them with the booking information (details, start and end times, chat and cancellations). This does not limit your statutory rights.

Opening chargebacks for services that were properly provided, or repeatedly without contacting us first, may lead to the suspension of the account. If a chargeback is resolved in the client's favour because the service was not provided or not provided as booked, 4clean may deduct what was transferred to the professional for that service from their pending payments or ask them to return it.

7. Right of withdrawal

If you are a consumer, you have the rights granted to you by Spanish Royal Legislative Decree 1/2007, the consolidated consumer protection act (TRLGDCU), including the right to withdraw from the contract within 14 calendar days of its conclusion (when the professional accepts the request), without giving any reason. Services are booked for a specific date, which may fall within that period; when you book, you ask for the service to be provided on the date you chose.

  • If you expressly asked us for the service to start within the withdrawal period and you withdraw once it has already started, you will pay the proportional part of what has been provided up to that point (Art. 108.3 TRLGDCU).
  • You lose the right of withdrawal once the service has been fully provided, provided that you gave your express consent for it to be provided within that period and acknowledged that you would lose that right once it was completed (Art. 103 a) TRLGDCU).

To withdraw, send us a clear statement at hola@4cleanibiza.com indicating the booking; you can use the model withdrawal form in Annex B of the TRLGDCU, but it is not mandatory. We will refund any amount due within 14 calendar days at most, using the same payment method.

8. Team bookings

  • You can book up to 4 professionals to work at the same time in the same place. The platform suggests teams whose members can cover the entire time slot and share at least one language.
  • A team booking consists of independent contracts with each professional, linked to one another. Each professional accepts, performs and is paid for their own part.
  • If a member cannot make it, we will let you know and you can keep the rest of the team or cancel at no cost.
  • Professionals can form regular teams on the platform. Joining a team is voluntary, you can leave at any time, and it does not create any employment relationship or partnership.

9. Client commitments

  • Describe the place and the work truthfully, and provide access at the agreed time.
  • Provide a safe working environment and give notice of pets, alarms or any other relevant circumstance.
  • Do not ask for tasks that are illegal, dangerous or unrelated to the booked service.
  • Treat professionals with respect. We do not tolerate harassment or discrimination.

10. Terms for professionals

  • Be legally entitled to provide the services on your own account (registered as self-employed or as a company) and comply with your tax and Social Security obligations. We recommend that you have civil liability insurance.
  • You are an independent professional: you decide whether to accept each booking and how to organise your work. You are responsible for your own taxes (such as VAT, IVA in Spain, and personal income tax, IRPF) and, where applicable, for issuing an invoice to the client for your service. The rate you publish is the final price for the client, including taxes.
  • To get paid, you sign up with Stripe from your professional area (Stripe Connect). Stripe verifies your identity and your bank account, and you must accept the Stripe Connected Account Agreement, which governs your relationship with Stripe. Your share is transferred to your Stripe account, and Stripe pays it out to your bank account according to its payout schedule. Until Stripe activates your account, the amounts remain pending and are transferred as soon as it is activated.
  • Keep your profile, rates, areas and availability up to date. What you publish must be true.
  • Respond to requests promptly, arrive on time and deliver what was booked.
  • Keep addresses, codes and any client information confidential, and use them only for the service.
  • Handle payments within the platform. You may not divert clients you met on 4clean in order to charge them outside it.
  • You accept the 10% commission, which is deducted from each transfer, and that we report to the Spanish Tax Agency (Agencia Tributaria) the information required by the rules on digital platforms (DAC7).
  • Repeated cancellations and no-shows may affect your visibility or lead to the suspension of your profile.

11. Reviews

Only clients who have completed a booking with a professional can review them, once per booking. We do not pay for or incentivise reviews. We remove reviews that are offensive, unrelated to the service or that include personal data. The professional can ask us to look into a review they consider false.

12. Liability

Each professional is liable for the proper performance of their service. 4clean is liable for the proper operation of the platform and for diligently handling payments, refunds and incidents.

If any damage occurs during a service, report it through the booking chat or to hola@4cleanibiza.com as soon as possible, with photos if you can; we will mediate between the parties. Nothing in these terms limits any liability that cannot be limited by law, or your rights as a consumer.

13. Suspension and account closure

You can close your account whenever you like from your profile or by writing to us. We may suspend accounts that breach these terms, after notifying and hearing the person concerned, except in serious cases (fraud, violence or risk to other people).

14. Changes to these terms

We may update these terms to adapt them to changes in the law or in the service. We will give you reasonable advance notice; bookings already made are governed by the terms in force when they were made.

15. Applicable law, complaints and jurisdiction

These terms are governed by Spanish law. For any complaint or claim, write to us at hola@4cleanibiza.com; we will reply as soon as possible and always within one month.

If you are a consumer, you can also contact the consumer affairs services of the Govern de les Illes Balears (the regional government of the Balearic Islands), and the courts of your place of domicile will have jurisdiction. In all other cases, the courts of Ibiza.
